InactiveNot sure if you can do that Dom. That domain sounds pretty “generic” in the sense of trademarking.

InactiveI can do that.
Says my lawyer.
And I will do that, no one is going to ride on my 5 years of 12/7 work!

InactiveWhilst I wish you the best of luck, Dom, I’d have to agree that ‘games and casino’ is very generic and I wouldn’t fancy my chances in court with that one. Like I say, I wish you the best of luck though.

InactiveI’m going to have to agree with everyone else here Dom. Don’t think anyone would pay 6k for them names anyway so you should be safe.

InactiveTrademark law as applicable here:
Trademarks that are descriptive and have achieved distinction through sales and advertising can be protected under federal and state law.
One trademark legally conflicts with another when the use of both trademarks is likely to confuse customers about the products or services, or their source.
In case of a legal conflict with a later user, the first commercial user of a trademark owns it.
If a legal conflict is found to exist, the later user will probably have to stop using the mark and may even have to pay the trademark owner damages.

InactiveUS trademark don’t mean crap unless you go worldwide with it, and even you can’t afford that

PS! I have bestonlinecasino.xx and would really like to see someone get a trademark on that term…

InactiveI have to agree Dom it’s going to be pretty tough to sue. Truth is lawyers say anything it’s not like they have anything to lose.
It would be like me trying to go after casinorankings.com casinosranking.com casinoranking.net etc

InactiveI dont think they will get 6000 a piece for those domains; but if they do what do you care? Next until they are actually doing something that jeopardizes your site not much you can do other than take it to WIPO. And unless they are doing something that harms your site by confusion etc not much you can do there either. Are you really going to sue them in a US state for a online gambling domain? LOL
Also, you should have went for a service mark not a trademark; I dont see you getting a trademark for those generic terms; unless you went with some back street country like others have, then the mark doesnt hold much weight in the states.
Sure you lawyer will tell you that you can sue for that, but its surely not a wise choice. A lawyer will tell you anything, they want to start eating that retainer and adding expenses.

I will sue, even if there is no guarantee for winning. So I either lose or set a precedent.
But I will also make sure these sites never make it in the search engines, should anyone be dumb enough to try.

InactiveThe person selling these obviously KNOW that you have gamesandcasino.com or else he wouldn’t have listed them for such a high price. It is unethical IMHO. :fencing: Hopefully, no one will buy them.

Which is why I am not buying them, but I WILL waste my money on a lawsuit, even if only to make the other party pay and pay and pay to defend themselves.
