Well unless you had the domain prior to their existence or registered it with absolutely no knowledge of their existence, then you have no arguement.

I assume that domain name you have is undeveloped?
Or that they’re not interested in the development you’ve made ?If so then you’ve effectively got a domain name that is their trade mark – and if they wanted to – they could probably sue and take that domain name from you ….
:huh:(if you have an existing and defined brand of your own then this may not be the case)
So what you need to do is to pitch it at a price that gets you a tidy profit – and is also cheap enough for them that paying you is the simple and smart move.
I would agree with you that a price of Euro 5K seems a good pitch and you probably should add a bit more on … in order to let them knock you down a bit.
:roflmao:10K might be a psychological barrier …
so try 8K and accept anything between 5-8K …
But make sure you get it all signed down in a contract.

I dont want to release the name but i can tell you that i can launch a site about sport betting and it will suit my site better than it would a casino site

Sure, i know they can sue but its cheaper for them to pay than to go to court and get a domain name and nothing more since i got nothing hehe
Believe me I WOULD not do this if i didnt know they can afford it.

I think that’s the key here mate … make it affordable to them – and still profitable to you.Some general ideas.
(1) Be friendly but firm.
(2) Point out that selling the site will derail a significant part of your internet strategy .. but you understand their interest in the domain name.
(3) Say that you need to cover reasonable expenses for managerial planning, strategic work, and pre-production website design that will be lost ( :tounge2: )
If I heard that then I’d understand why you may have some expenses to re-coup …

InactiveTo be honest I wouldn’t be very concerned about the risk of trademark infringement or them suing you – if they’re based in Antigua or a similar place, they may have no legal base in the EU and no right to the name at all. And if they thoughy they could sue you and get the name for nothing, I’m sure they’d do that first rather than trying to bargain with you.
I’d go in at $10k.

I said my price and they said what they had to say, anything someone would say. Then they said 500 $. I said no and lowered to about 5 G, but no luck. Just threats in a nice manner from them

I know they are trying to scare me so I checked everywere to see if they have a registered trademark and could not find one. Not even one in the
UK were the companying owning them operates … under different name.I checked a name simillar to theirs and its trademarked in ireland. So the database makes me feel safe to say NO TRADEMARK. Could that really be?
They said ok. 1000 GBP I said ok. then they said sorry i meant $ So i said listen 2000 firm or im putting an online forum about internet betting.
Latest they said
Please remember that we will go to whatever lengths that are necessary to protect our name. I had really hoped we would not come to this if you insist in proceeding in attempting to gain and promote any form of gaming using our name.
However the decision is of course yours how you proceedSo, ill take your vote to guide me

Should i throw a forum on the domain…. or should i keep it parked or just blank page saying betting forum coming soon..

InactiveI’d say “see you in court then” but I’m a stubborn bastard when it comes to stuff like this so perhaps my advice shouldn’t be the one you follow.
Saying that, I’ve been in a very similar situation before when I told ’em that the threats didn’t bother me and that I’d be happy to wait for court papers.
They paid up – my price.

Here’s something else you might consider, though only if its a top-notch casino. I spotted a domain (variant) of a well-known online casino on Ebay, bought it, then phoned the casino aff program up and gave it to them to pass on for free. Ever since they’ve sent me invites to sports functions, given me some “flexibility” on requests and we have a pretty good rapport now.

I might be mistaken because i do not know anything about this , but if the name is not trademarked , why dont you go trademark it

itll cost me to do that (register TM), besides they have been on line for over 5 years. so they might have some right….
Either way desputes cost 1000 + euro for a .eu domain and they know this.
might do the same like you Fictionnet hehe Cause i dont care either.

InactiveFirst you should have the domain appraised. Then you should hire a service to do the selling for you. They have lawyers to handle whatever this casino throws at you.

We came to an agreament and i sent an escrow transaction… never heard again from them. emailed once more but no reply.
Dont know why?
By the way dont all trademarks have the R nect to their logo or atleast stated on the page?
Im sure theyre not trademarked, perhaps in a specific country. thats what i think anyway, otherwise i would have gotten the official letter.
Should i go back to a higher price when they do decide they want it? or should i launch the forum, but then there want be any posts hehe
