    It should not be in the general t&cs if it’s something that is part of an individual contract.

    a number of high revenue share deals of 40% and above we had made with certain affiliates for top positions on their sites

    ben, this also comes in light of your organization’s fiasco in february. just because a month has passed, you cannot expect your partners (yes, affiliates) to jump onboard straight away or at any later point if that matters.

    your organization fucked up. earnings got screwed big time. affiliates got their payments very late. none of my emails (in the moment of crisis) were replied to (until i bitched here) ….so this brings me to the question, if you were in my position, would you start advertising rushmore as soon as they claim to get their processors right?

    you see, the first time this was said it was wrong, nothing was fixed, it only got fixed 2-3 weeks later. so if you want affiliates to work with you on a trust basis, and your contract does not really imply anything else but that, how could you feel honorable in backing out of your prior deals?

    the deals you are now deciding to retroactively back out of were made under the assumption that your casino could receive deposits all the time and that you would show appropriate statistics. as you know, there was a massive time lag in this issue while you were busy discussing the rushmore party on CAP forum.

    i do think that this is out of order. in the beginning of february your whole system crashed, 2 months later you are cancelling out on an agreement you never fulfilled…beautiful. very ‘white house’ like. go go UIGEA

    Ok now, the system crash wasn’t their fault. If your site is ever under such an attack (mine was) you will develop sympathy for that situation. I think they handled that very well, caving in to such attackers ruins everything for the rest of us.

    Processor problems – who hasn’t had them?

    I am just saying that the new clause in the T&Cs should be part of the private contracts it actually applies to.

    Splinterfree – please keep this type of thread out of the AGD forum. This is about terms and conditions. I understand this affects you personally, but in the C-Planet forum – Ben had created an exact post and that is where this should be taken up, IMO.

    BTW – not invalidating your points, I just feel we need to keep the topic on track.

    I understand your frustration and I will address each of your points, I do not want to get into a posting war with you rather to resolve the issues and put your mind at rest so we can continue to work together.

    1. If you are referring to the Processing problems, it hit us all badly, we are not to blame for the processing going down, however admittedly we could have handled it a lot better and kept you the affiliates in the loop more. Late payments are not acceptable and we admit to that, however everybody did get paid. Earnings for everyone got screwed including us, the fact that the processing went down is a bi-product of the industry we are in, we have now fixed it. If an affiliates SEO messes up and he drops 50 places on Google we do take him to task for this.

    2. I am not your direct Affiliate manager, however if you feel that your e-mails are not being answered. Please feel free to contact me and I will address them immediately.

    3. As I mentioned in my previous post we are not backing out of any deals.
    I want to assure everyone here that no affiliate has been effected by this change, no ones revenue has been altered and there are no plans to do so.

    4. My post about the Rushmore party was my second ever post on CAP and I wanted to share with you all the fact that we and other industry members had a great night out.

    5. Again we are not cancelling any agreements.

    I understand that trust needs to be earned and that we have made some mistakes. I can understand your reservations.
    I hope that we will manage to earn that trust with you.
