vladcizsolMemberCommissions will no longer be placed on hold or frozen. You will receive commissions for the life of your players, BUT if you are not active you will be paid at a lower rate until you start promoting them again.

InactiveDoes this apply to affiliates who already have a signed contract with BCP and already have an established player base under that contract?
That is the only issue I see. As a new affiliate, I can decide if I want this clause or not and choose accordingly.
If the players are already delivered at this time, I am forced to accept or lose my player base. BCP has a contract with me to pay for that player base in a certain fashion. Is that now null and void?

vladcizsolMemberDom thats not a question I can answer. I dont know of any signed contracts you may or may not have with BCP or if there is any due cause to believe any contract which you might have would be null and void.
Please consult your attorney or Larry Walters. I am not an expert in contract law and I doubt many of our members are practicing attornies.

InactiveWell, I am hoping to get an answer from BCP. I am sure they understand what I am saying. We all have a contract with them – it’s outlined in the T&Cs. Some may have additional side contracts.
Once they give me a clear answer to this, I can decide to either put them back up on my site or not.

InactiveOur reason for applying this term is simple. We firmly believe that any true partnership is based on communication. When there is no communication there is no partnership. Granted, we could have quietly shaved accounts like so many other programs do, but we chose instead to put our cards on the table. We understand that not everyone will appreciate our frankness but this is a risk we are prepared to take. There has never been a single incidence of any account being locked over player quotas not being met. Our affiliates have been paid, and will continue to be paid, millions of dollars in revenue every single month. To those who choose not to promote our products in spite of this, we respect your decision and all we ask is to be given the opportunity to establish our own policies and higher industry standard without being subject to unfair and baseless accusations.
There are just so many things in this paragraph that makes me cringe.
Mine was put on hold and was told that I needed to contact my aff manager.. Not once did they try contacting me in the past – so if communication was so important to them .. why did I not get an email?
I hate it when programs try making themselves look good by deflecting and say that “we could shave like loads of others” .. this never was the issue – why bring it up?
Never once was an account locked??????? Locked – Hold.. symantics… Also.. I know of a couple of affiliates where there passwords were changed “or something went wrong”.. hmmm
and this is the worst of them all-

Since when is YOU breaking the terms of our contract baseless?? We signed up in good faith… it was up to you then to get in touch with us BEFORE you change the contract so that we can decide if we wanted to continue..

InactiveIf anyone needs to have THEIR T&C contract, in it’s original context delivered to them by AGD for the purpose of allowing your lawyer access – please contact us with the date you signed up with BCP. We can pull the contract for that date, specifically, and email to you.

Their statement needs to include information on this term in regards to retroactive enactment of this term upon existing affiliates. THAT is the issue here.
Most affiliates will NOT sign up with them under the new conditions, so that really is not a major issue to most of us. The major issue is the applying of a term retroactively and it would be nice if they could speak towards that issue.

I didn’t read the last 2 or 3 pages as I’m pressed for time but felt compelled to post my disagreement with Stupid’s post about lifetime accounts.
I’ve now been around almost 10 years and have in fact experienced the affs worst nightmare. I”ve lost my ability to gain traffic due to ad restrictions at reputable PPCs.
I do this full time btw. If not for my having weeded out programs that run predatory T&Cs I probably wouldn’t be here today.
Many wonderfully kind folks here at CAP have tried to help me but the jump to seo is so foreign to me that its like trying to learn a foreign language. I take this op to again thank everyone whom I won’t mention by name because I don’t want cause them any further interference in their business than I have already been (I fear they’d be contacted by a horde of newbs) … but you and I know who you are and I am very grateful even if I have failed to show it by being more successful at this new endeavor.
I am still largely riding on residuals and have been for well over a year. Yes I’m slowly finding ways to get traffic but its not been a picnic and I’d have long, long ago been put back to the lower % if I was with a place like the one in question.
I can say confidently that would have been my final nail in the coffin.
Stupid I hope you never go thru my last year (or two) because it (obviously) will be a real humbling experience. – side note on that: I used to think I had taken the wiser path because I would never be dependent upon the SE’s algos … and there were times in that past 10 years when I saw many successful affs experience highs and lows I did not … due to SE rankings changing. But in the end I had the humbling experience that i thought I had been wise enough to avoid.
anyway there were also times during that 10 years when I pulled sponsors because they weren’t producing and they literally without any exposure aside very back pages … jumped to 5 figures for over a year. *I should have never put them back up because they dropped off when I did … and have never come close to recovering .. sigh.
I had one sponsor I pulled because they had some bad press I didn’t want to be associated with … that sponsor despite having bad press from a large number of affs … showed me decent income for close to 3 years after I stopped promoting them.
And I would guess I probably have a lot less players signed up than Stupid or many others here … so I don’t know where Stupid gets those figures but my experience tells me that residuals are going to be huge and that anybody who enters into a deal where you lose your income if you don’t send new players … is going to be extremely sorry.
And they’ll have some sort of income arriving every month from the good sponsors they promoted … to remind them how much more they could have had if they’d been smart when they had the chance … and if necessary cut their losses now while its only damaging .. before they grew to a size that when the plug gets pulled … it will be devastating.

InactiveBased on our conversations with members here at CAP and our certification team, we have gone ahead and revoked BCP’s certification on CAP. We strongly felt that the concession we were able to obtain in Barcelona from BCP’s management team was a step in the right direction for the affiliate community, but obviously that is not the case.
Over the past 7 years, nothing has been more important to CAP than our affiliate community, and as affiliates ourselves, this will always be the determining factor. We’re sorry for the aggravation this has caused everyone. We appreciate everyone’s feedback and input and you can be assured your voice is always heard and valued here at CAP.

I don’t know why you feel that wasn’t the case.
I think we all openly expressed our gratitude for the effort.It was however, just a step, and we really need a forum to work it all the way thru with them on.
Now that’s gone too.So can someone tell us where this all stands now?

vladcizsolMemberIts dead Nick for gods sake leave it alone. They will be happy to talk with you one on one at length whenever you care to discuss it. Their position is inflexible and they had the opportunity to post or respond and they chose not to despite a promise to do so. We have all had enough of this disruption and this circus. This Jerry Springer side show is not what CAP is about and its done.
Anyone who wishs to work with BCP thats their decision, anyone who doesnt want to its their decision. You know their position. Based on the community input we received we are NOT certifying them and I really want us all to move on to productive things like growing our businesses and planning for the future.
Please honor this request. This whole thing has given me enough gray hair already. If you need BCP direct contact details you can PM me and I will be happy to provide them to you as a courtesy.
Thank god this nightmare is over.

Any future earnings on these accounts will be forfeited automatically. “Inactive” is defined as no new qualified players delivered within this prescribed period.” Despite having gone to great lengths to express both publicly and privately that this term would only ever be applied “subject to review on a case-by-case basis” and regardless of the fact that, to date, there hasn’t been a single incidence of this term having been applied to any affiliate, this change appears to have become a source of much discussion on the CAP forums. Throughout this time we have maintained a healthy dialogue with both Warren and Lou and we are extremely confident that they understand our point of view and our commitment to fairness in all cases.
Historically we have chosen not to engage in a public debates over company policy, as well as other business related issues. Will this apply to someone who has suddenly lost their Google ranking? No. Does this apply to someone who has fallen ill or suffered some other type of life crisis?
