    Personally, I see affiliates as a contracted-in sales force and we are in the business of “delivering” players to an agreed contract. Providing the contract is honoured, then I see the players as the property of the operator. If the contract is broken, then I guess one could argue that case if the facts are available.

    That is correct. We are a commission based marketing channel. That is the basis on which we are contracted and we do so knowingly.

    Unless you own player data, you don’t own anything but an anonymous click.

    On CPA, the casino owns the player.

    On revenue share, the casino owns the player minus the agreed percentage.

    On media buys, the casino owns the player.

    No one really owns the player. (Ron – don’t quote me on this)

    A player chooses to play at a certain place – and we all make money from it because we treat him/her good.

    It is our honor that players choose to be part of your traffic and part of our community. This is not Trivial.

    Most affiliates add value to the players (community, reviews, comparisons, etc…).
    This is thanks to that value you add that you bring players to operators and we reward you for that hard work you do.
    Once the player is identified with the affiliate’s brand then you can say the player belongs to the affiliate: the affiliate makes his own marketing and ours is just an addition to help maximize the player value.

    Dom is right on that. A media buy or a CPA deal gets the ownership of the player to the Casinos.

    A revenue share deal SHOULD get the affiliate a part of the revenue for life.

    When a Casino is sold, closed, or absorbed by another Casino, the affiliate generally loses out unfortunately.

    no matter what, the casino owns the player. there is no question about it.

    whether they honour the agreement with you on owning the player is a different issue.

    we are nothing more than sales agents who dont get a salary but work on commission basis.

    Patricia – Some of the new operator owners know what they owe to their affiliates and know that it is for life. Unfortunately – these are not most of the owners.

    Even a sales person should be treated right – look at all the big brands – they must be doing something right :)

    That depends on who licences the software. If it’s a Microgaming casino they have generally proved that they ensure any buy-out includes liabilities. A direct failure may be a different issue although with MG that’s unlikely as the brands are strong enough normally to ensure the casinos will be bought. When CPS went under, MG were quick to assure the media that liabilities would be a priority.

    Although I am not aware of this happening, I would imagine Wagerworks and possibly Cryptologic would apply a similar principle. This is part of the reason why I think it’s important for affiliates to look at a) the brand strength and b) who provides the licences to the casinos they represent to underwrite some of the risk.
