    On Saturday, I received notice (postmarked July 13) that the Commission was instituting forfeiture proceedings against the property they confiscated in the office raid — several computers, a multi-function printer/fax machine, blank compact discs, computer programming manuals and the like. The Commission is going to sell our stuff.

    This is all quite troubling. First, unless you count Mr. Herrington’s “they’re committing a crime” assertion, neither I nor Betcha has been charged with a crime. No indictment, no judge, no jury, nothing other than Mr. Herrington’s “they’re guilty.” Second, the Commission knows there’s a civil action against them. Rather than wait for the court’s determination, however, they’re proceeding unwavered. (If that’s not contempt for the judicial process, I don’t know what is.) Finally, there’s no nexus here between the alleged illegal activity and the property in question. As to the computers, the Commission knows or should know that we purchased them months before we launched Betcha.com, so there’s no chance they were purchased with proceeds from our alleged illegal activity. Nor does the Commission seem to care whether the property was used in the commission of a crime. It’s very difficult to argue, for example, that blank compact discs were used in illegal activity. They are, after all, blank.

    (If you’re wondering whether there’s anything we can do about this, the answer is “no.” Under Washington law, the Commission has immunity from liability for any actions they take in furtherance of enforcing the law. That’s not their fault: the Washington legislature created a system that all but invited a gestapo. The current crew just took the invite.)

    Welcome to America.

    Over the last 20 years, all sorts of forfieture laws have been passed. All of these allow the government to sieze your stuff based on “suspicions” that they were related to a crime or proceeds from, etc. Once this happens to you, you must prove that you didn’t do anything wrong (yes guilty till proven innocent) to get them back. Sometimes even after being acquitted of charges, people can’t get their stuff back.

    Border crossing – Declare if you have more than $10,000, if you have more than that and don’t declare it, they can sieze your money.

    Soliciting a Hooker – Get caught soliciting a hooker in your car, they sieze it.

    Smoking a Joint – Get busted in your car – they can sieze it under forfeiture

    Growing Pot – Have a couple of plants in your house, they can sieze your home.

    All of this before your are charged or convicted. Lovely.

    Its all true.

    still don’t know why i didn’t lose my house after getting caught growing a few plants … about 10 ….though i was charged with over 40 …… (they dug up daisies and stupid bastards actually left a couple pot plants) ……

    I feel very lucky to still have my home. part of this may have been due to my starting the plants very late….. and for those wishing to know. ….. you can start a pot plant in late july and still get a nice bud on each one….. at end of the season….. in fact …. its a better approach because too much rain can kill them so starting early in spring is a bad idea.

    better to have many small plants started late than have large ones …. easier to spot …. that were started in spring.

    I made the ultimate mistake…. one i’ve never made in many years but got stupid. NEVER grow on your own land. choose a public land such as under electric lines or parks …… or your neighbor’s ….. (they won’t be charged because they didn’t know and unless they’re smokers too … won’t be persecuted)

    the whole thing sucks. alcohol kills thousands every year. from disease to drunk driving. but get caught growing a little for your own use … and they stick you.

    I used to be patriot. now I’m ashamed of my country and the way it is run. I once would have went to war for it. now i cannot in many cases support the reason for its wars.

    Very disillusioned. and I think rightly so. Hell I’m not perfect but I have NEVER (other than one time when I had to decide me or him) ….. ever passed up someone in need of help. THAT is the kind of person I want for a neighbor and citizen. not someone who supports propeganda and blindly believes everything they’re told.

    I’m in BC and most cops will just turn their head if they see someone smoking a fatty… I haven’t touched that stuff in 3 or so years, though :tongue: I think it’s an incredibly silly thing to get pissy over – it’s a plant, just like tobacco, and instead of making people get really, really, really stupid (drunk driving, anyone?) It makes them hella calm.

    OH DANGER! He’s heading for the pantry — get ’em boys!

    The gentleman in question is Nick Jenkins. He’s a great guy and a real trouper… has a lot of balls.

    I am meeting with Nick tomorow to discuss his situation, and formulate strategies… and to see about working together.

    We interviewed him a few weeks back (listen here), before he was raided.

    We will keep you informed.

    understand IX…. but I ask you don’t judge us all on the acts of the gov we must toil under.

    There are a lot of good people in the states. They came out and voted W out of office but he stole this election much like he probably stole the first one.

    Daddy has a lot of power. a lot of people don’t seem to get that he was head of the CIA (our version of the kgb) for 10 years …..before being VP for 2 terms .. and then prez for 1.

    as rumor has it …. things go on in the CIA that even the prez doesn’t know about. imagine the power this rich prick has held and for how long?

    its no stretch of the imagination that the whole Reagan era .. poppa B was pulling a lot of strings nobody recognized … or wanted to see.

    I’m apalled by the last 8 yrs. I know many others feel the same. But we’re stuck. Thank God its almost over.

    I can only hope things will change for the better.

    About George Walker Bush and his corrupt Administration being lead by the Evil one Dick Cheney, isn’t there anyway these criminals can be charged in the United States for War Crimes after they leave office. If anyone in this the 21st century has promoted terrorism in the World more than Bush and Corruption, I would like to know who they are.

    This Administration has pissed all over the constitution, have proven to be the most corrupt, incompetent and lying bunch of politicians that the American people have ever seen. Bush and Corruption could care less about the average American as the only ones they care about are themselves and how much they make for Corporate America by prolonging a War based on lies in Iraq.

    George Walker Bush shows how much care he really has or compassion as the phony born again Christian has never attended one funeral of any of the Soldiers that have either died in Iraq or Afghanistan. I hope that this idiot of a President realizes upon his death bed that he will never enter the Pearly Gates of Heaven but will spend eternity in Hades where he belongs.

    Enough of my Ranting, but the man and his lies make me want to throwup.
