Q: Is it legal to gamble online from the United States?
A: That’s really the issue that’s being debated at the moment. I think the Department of Justice takes the position that gambling online from the United States to any site that’s based anywhere is covered by the Wire Act and thus is not legal.That was so until the federal communications commission (FCC), who has jurisdiction in this matter, decided this year that the internet and the telephone line are two entirely different things and are not covered by the same law.
Hence the Wire Act, which covers betting over the telephone, does NOT apply to the internet anymore. Many doubt it ever did.

But since the FCC decided this not based on the gambling issue but based on the internet telephony issue, and since the FCC is not a very prominent agency, and since it is not in the interest of the DOJ to publicise this at all, it has been widely ignored.
But the fact remains that the internet and the telephone cannot be considered the same thing in the eyes of the federal communications commission, and that makes it law.
