    It seems a little strange how they made it a point to only refer to septembers commissions instead of using words like “all commissions”. Perhaps it is just bad wording by the writer.

    There are no new restrictions that prevent Affiliates based in the US from promoting PartyGaming brands to non-US players.

    Please verify this I’m pretty sure this is inaccurate.

    Since they used the word retrospective, Does this mean that if Party reverses their decision to ban US players, affiliates will have lost all the players that they referred.

    I’m pretty sure this is TRUE.
    The US gov’t has never had a problem with US based companies or affiliates promoting casinos or poker rooms as long as they didn’t target the US players.
    MGM Casino set up an offshore casino a few years that only targeted non-us players, and the gov’t and the state of Nevada were fine with it.

    If companies such as Party and 888 stop accepting funds from US players, then they will be doing nothing illegal, and thus, it will be legal for affiliates and banks to continue doing business with the likes of Party Poker and 888.
    That is my take anyway.

    I tend to agree. The World Poker Tour (nasdaq WPTE) is incorporated in the U.S. They have an online poker room but do not take players from the US. They seem to be getting away with it.

    I say it had to be verified because of Professor Rose’s interpretation of the new law.

    The greatest danger here would seem to be with affiliates. Any American operator can be easily grabbed. This includes sites that don’t directly take bets, but do refer visitors to gaming sites. If the affiliate is paid for those referrals by receiving a share of the money wagered or lost, it would not be difficult to charge the affiliate with violating this law, under the theory of aiding and abetting. Being a knowing accomplice and sharing in the proceeds of a crime make the aider and abettor guilty of the crime itself. The federal government could also charge the affiliate with conspiracy to violate this new Act.
