    The revelation that an online casino has been ordered to appear in front of a grand jury in the Eastern District of Missouri has sparked speculation that a wider reaching crackdown on gaming sites and their operations maybe imminent in the US. The company, whose identity is unknown, was told to present all commercial and financial records from, 1997 to the present, that relate to the advertising of online casinos and sportsbooks.

    Federal law currently prohibits online gambling to the extent that any organisation accepting money to display advertisements can be viewed as aiding and abetting an illegal activity. Assistant Attorney General John G. Malcolm is unequivocal: “The sheer volume of advertisements for offshore sports books and online casinos is troubling,” he continues, “because it misleads the public in the United States that such gambling is legal, when in fact, it is not.”

    The authorities have certainly got a job on their hands if they’re determined to police such ubiquitous advertising, but it seems that they’ve decided to throw down the gauntlet.

    How can the eastern district of Missouri tell an online casino to appear before a grand jury?

    How does eastern Missouri’s jurisdiction extend to offshopre businesses?

    That’s a federal court Dominique. They can subpeona anyone they wish. If you are a US citizen, a resident of the US or do business with US residents you are likely to be subject to legal action.

    Setting up an offshore corporation slows the process, but it does NOT shield one from prosecution. If it did EVERY illegal enterprise would set one up and thumb their noses at Uncle Sam. Obviously the US government will not allow this to happen.

    I am sure Jay Cohen set up an offshore corporation and if I remember correctly his Sportsbook was in Costa Rica. He was still treated to a stay in a federal prison.

    yah I recall seeing that on 48hrs or 60 minutes, dateline I believe they have all ran the story about him several times. That was crazy – you can run, but you cant hide from big brother.

    I’m kind of new to this and am trying to find out if they’re going to come after the advertisers in the US. After reading about the supboena, I was wondering why the websites would be illegal but I hear radio advertisements for sports betting all the time. Anyways, in searching for information I ran across this story. It appears to be related to the website case as the same court called on Clear Channel also.

    NEW YORK, Nov 7 (Reuters) – Clear Channel Communications Inc.(NYSE:CCU – News), said in a filing that the U.S. Justice Department asked for information related to gambling advertisements run on some of its stations.
    The U.S. Attorney for the Eastern District of Missouri issued a subpoena on Sept. 9 for Clear Channel to testify before a grand jury in relation to ads from “offshore and/or online (Internet) gambling businesses, including sports bookmaking and casino-style gambling.”

    Clear Channel said it is cooperating with the Justice Department in the inquiry.

    Shares of Clear Channel closed at $42.17 on Thursday.

    Cohen actually set his company up as a public company in the begining and he only had it licensed outside the US. He said that he fgured since it was set up and licensed outside of the US he would be then shielded. If he would have set it up as a company from Costa Rica instead of the US he has speculated that he would have not had as many problems …

    Also I think he has finished serving his sentance and his partners do not return to the US but travel else where as they are in exile at this point. Exiled in paradise would not be that bad I guess huh ? Though I would hate not being able to return to my homeland because of some fat cat politicians that feel they no what is better for us then we ourselves do. As well as telling us how to spend our own money we personally worked our fingers to the bone working for.

    The US is only giving up mass taxable revenue to many other nations of the world and well maybe they will figure that out sooner rather then later. They also have set up KENO that takes bets via phone lines through a few lottery associations and that is also violating there own laws. This is a very interesting angle because they are saying do not do as we do but rather do as I tell you … which leaves capitalism behind and lends a taste of dictatorship in my mouth ….

    I do wish that we could all get some legislation going for online casino betting in our favor … The adult business has worked at this a long time and have stopped legislation against them every time. But in order for this to happen our larger aff programs need to get it together and help us instead of falling down every time they are handed the ball.

    shit, most of them aren’t far-sighted enough to even realize that not cheating their affiliates would pay off huge in the end.

    How can we expect them to have the sense to go lobby and turn a tide that can kill their biz?
