    #1 Carry on as normal, simply transfering the site owners name to mine and use my offshore host, update the neteller details on affiliate site to mine, you will still be able to check all your stats and update your sites as per usual, and I can send you a check every month. For around 10% of your commission.

    Or actually just move all the site details offshore yourself and get the neteller sent to me – or another non-us citizen and get them to send you a check. Total bypass of the banks.

    Okay guys, here is something else that we can do for further exposure. I found a post on DIGG.com, which is a huge social networking websites. If enough people DIGG an article, it will get exposure and be placed on the homepage. I wouldn’t be surprised if it is some 10,000+ US users.

    Here is what I need from you guys:

    1) Read the gambling bill article at DIGG: http://digg.com/politics/Internet_Gambling_Bill_Passed
    2) Sign up an account at DIGG
    3) “DIGG” the article.

    If it gets “dugg” over 35 times (already at about 23) then it becomes a very popular article and will receive even more exposure. I also recommend that you sign up multiple accounts if you can. Just use a different username and different email address, then digg the article again.

    I don’t get anything from this, I am just trying to save our asses by gaining our exposure and lobbying against this ruling.

    I am in the wait and see camp myself, but what about making an offshore corporation that owns your sites (with offshore hosting), a corporate Neteller account for that corp, and you are an employee of the corp and take a salary (maybe as spokesperson). Possible issues are that someone needs to be an officer of the corp, which you could get around with another corp being president or a partnership or something. Sooner or later, at one of the levels, you would have to be involved as an officer though which might put you back at risk. (although much harder to identify and/or prosecute)

    This is starting to feel more and more like money laundering LOL.

    This of course is just for the affiliate payment side of things. I think the larger concern is how are our players going to fund accounts if all the intermediaries either A) get shut down or B) stop taking EFTs but start accepting “creative” ways of funding, such as money orders, phone cards, etc, etc. I just think at some point, the hurdles (and costs) our customers will have to jump through will not be worth it for all but the most hard core gamblers. Hopefully a new “4th party” will be developed as Professor mentioned to insulate all concerned parties from risk. Hey, there is a good site idea for someone. We could call it “Fristeller” and its whole purpose would be to move funds from Neteller to the Casinos while somehow shielding the fact that it is going there. :clapper:

    WTO Ruling and Antigua

    If Antiqua wins against the US then we can expect to see some changes to this bill. Can somebody here help me research the details of this WTO case? The US was supposed to allow Antigua based online gambling operations and their deadline was in April. Now that this bill has passed I think that we’ll hear more from Antiqua about it, as well as the WTO.

    Remember, that this won’t be a big deal to the US financially, but the involvement with the WTO is a political monster.

    This isn’t really bad at all if you think about it. Illegal enterprises are far far more profitable than legal or even grey area ones, especially if it was recently prohibited and already has a huge and willing customer base. And especially if most competitors will fall away due to respect/fear for the law.

    CbWhores, that was a very insightful post. I’ve thought about the same thing myself. Are there any gambling attorneys that might be able to provide us with some direction on something such as owning “stock” in an offshore gambling company (that one would still operate from the US)?

    I think that it gets complicated because if you are still operating from the US, which I assume most US affilaites will be doing, it doesn’t matter where the corporation is located. I asked my CPA about this once because I was going to incorporate in a state such as South Dakota or Nevada or even get residency there to avoid state taxes. He said it wouldn’t matter because I’m still OPERATING from Minnesota and MN taxes would still apply.

    I for one, will be taking a “wait and see” approach, and I think that is the smartest strategy at this time, rather than knee-jerk/impulsive reactions to this.

    This bill was passed less than twenty four agos ago. We don’t even have clarification(and won’t for while) on exactly what it means, or what impact it has on the industry. There is also no public responses as of yet(that I know of) by the people most affected by this bill, that being poker rooms, casinos, bingo halls, Neteller, etc etc.

    While I understand your reasoning for the post adio, and I too am not happy at a lot of the negativity being thrown around, and also agree that it is a very good idea to work out contingency plans, I believe it is way to early to start this process yet, as we don’t even know what we’re planning against.

    Just my two cents :)

    To summarize what was passed, this bill is designed to prevent the use of payment instruments (credit cards, fund transfers, etc.) for certain forms of online gambling that are defined as “unlawful Internet gambling.”

    The bill requires financial institutions to identify and block payments related to so-called unlawful Internet gambling transactions.

    If there is a violation, the government may file a lawsuit (known as an injunction) to prevent or restrain the violation.

    The bill provides a special exemption for three types of Internet gambling:
    (1) horse racing under the Interstate Horseracing Act (IHA), so OTBs and account wagering systems can remain in business,
    (2) Indian gambling that takes place on a reservation or between two reservations; and
    (3) Internet gambling that occurs solely within a state’s own borders, referred to as Intra-state gambling.

    … the President will sign this legislation within two weeks, but it allows 270 days before it is regulated and enforced.


    MY Comment :

    So I think they’ve protected horse-racing, state lotteries, Indian expansion, and perhaps local casinos offering an online option … (interesting).

    This does seem to fly directly in the face of WTO ruling on foreign internet gambling – basically you cannot lockout companies if you are allow internal gambling …

    But since when has Bush even considered outside influences eh?
