    When someone set up a website called “fortuneaffilliates.com” (note the extra l) Fortune affiliates blew them out of the water in a second flat.

    When I used a search term suggested to me by word finder I was sued for a million bucks ( the suit was actually filed) for trademark infringement.

    It is expensive to get out of these suits once filed. I don’t recommend it.

    So, negotiate by all means, but don’t let it escalate into a suit.

    Gonna tell us what the domain is?

    I’d like to know who says something like “”A technical error with our domain registration company allowed you to register….”

    Sounds like you’ve already made up your mind, but I’d ignore them if it were me… or maybe point out how much screwing with WIPO costs.

    thanks guys for your input. i really appreciate it. i am going to give them the name. not worth fighting for something that is not currently making me money.

    in regards to the actual domain name, i would prefer to keep it private. thanks for your help.

    As far as I understand, for trademark infringement, they have to have the name/domain either trademarked, or need to be operating a business with that name, before you did/do.

    If their website is up, transfer the domain, otherwise get the site up and running.

    got to http://www.uspto.gov and do a trademark search, to see if they have one

    I had a similar problem using the word ” ****” in my domain. ” ****” contacted me and told me to remove site. “*****” is a trademark name and they had all right to do this, however I registered the domain before they did were trademarked.

    Needless to say I hired a attorney and I still have to domain.
    If your using a company name, you can be in violations of trademarks.

    http://www.brandxperts.com is the attorney who I hired and did a excellent job. It doesn’t cost that much to find out if your within your legal rights.
