I don’t think it’s the Kentucky issue at all since many of them switched their domains to .co.uk especially when that case isn’t finished. Assuming kentucky did win it only puts a damper on the issue since if all programs did lose their domains they will just simply switch. The downside is affiliates need to make sure their banners and text links are updated but the upside is affiliates benefit the most since those domains that compete for the same keywords are going to take some sort of SERP hit.
