I see a lot of programs with a similar term, but usually it doesn’t use the word ‘possible’. I find that word strange and alarming.

As far as predatory, I consider their offensive use of spammers to be predatory. Especially since those spammers are stealing our hard work. Their terms are a bit strange in a couple of areas as you can see at AffiliateGuardDog.com – but their spam work is what gives them the ‘predatory’ name. With the removal of the rackback term and the addition of the ‘possible fraud’ clause – I think their terms are also moving in the predatory direction.
