There is little doubt that there is a huge element of luck in poker – enough to make it “a game of chance”.
Also there is little doubt that what was being done WAS legal IF he had a gambling license.
I note the story also says :

Gutshot basically needs to apply for and obtain a gamblnig license before offering poker games for money.
