I am wondering if it is possible to file a class action suit on behalf of affiliates world-wide against PartyGaming to recoup damages sustained by their actions. Am I right, am I wrong? I would like to hear opinions on this.
Those affiliate on rev-share will definately see a hit in earnings its true, but as long as PartyGaming continue to pay the correct percentage I don’t see any breach of the terms and conditions of the contract.

I don’t think that affiliate partners have any implied control over PartyGaming and how the company chooses to do business – to suggest that is the case seems a non-sensical interpretation of the contract to me.
And of course there is the legal jurisdiction issue. What jurisdiction do you think you could file this in to have a chance of collecting?
I’m assuming the US (because this is usually where high priced class actions are filed) but I don’t think that it has ANY chance of enforcing a payout – even if it did decide you way.
In summary …
I DON’T THINK AFFILIATES HAVE ANY CHANCE OF SUCCESS IN A CLASS ACTION SUIT
