owning them in iteself isn’t enough for a claim.. for instance, if you own cookies.com and I own cookies.net, if you’re site is an informational site about internet cookies, and I’m selling gramma’s recipe.. then my site is not likely to be confused with yours and you are not likely infringing on my trademark… and vise versa..
In other words, to have any case at all, she has to wait until they build the site and see what’s there. If they choose to use the gamesandcasino url to promote popcorn, or some other off the wall non gambling item, not real likely a trademark infringement.
(Very vague example, but should be simple enuff to understand)
