I don’t see what you mean about an .eu gambling domain? casino.eu is doing fine – awarded to the first trademark holder with ‘casino’ somewhere in their trademark.
Once again, the whole thing boils down to the very simple question: do you have an EU trademark that contains the words ‘games and casino’? If so, fire away. If not, you’re just pouring money down the drain for now purpose (that I can discern)
I think axl’s point is that you seem to be declaring war as if you have some automatic right to every domain in the world with ‘gamesandcasino’ in it, but you don’t have any right to them unless you own the trademark in the appropriate territory and/or you got there first.
You’re assuming there is bad faith here, but of course there may not be. It might be some innocent guy who just had the same idea of you. Then you pile in threatening lawyers and legal action and bully/scare the poor guy to giving in to you, when in fact the domain is legally, rightfully and morally his. Then you are the bad guy.
If there was bad faith on his part then you can certainly (morally) threaten legal action and hope he gives in. If you then want to cut off your nose to spite your face, you could take it further.
I think our whole point is that your ‘crusdade’ seems rather bizarre and like sour grapes. You should have registered these domains up front, but you forgot and you got burnt – it happens. The implication in your posts is that you automatically own the right to all these domains, and that comes across as ignorantly arrogant – somewhat reminiscent of the ‘easy’ domain cases, where the Easy Group (who own EasyJet, EasyInternet,EasyCarRental and dozens of others) succesfully sued a whole myriad of domain owners that had Easy* in their names, even if they had owned those domains for years. They cajoled, bullied and threatened domain owners, and then sued if they still didn’t give in. Unfortunately they won a lot of their cases, though of course that’s because they did own trademarks. But they became the pariah of the internet in the process.
There’s really no need to go down that route, and I don’t think it will benefit you in the long run. I’d recommend registering the rest of gamesandcasino.* right now and then you won’t have to worry about this in future.
