As far as I understand, for trademark infringement, they have to have the name/domain either trademarked, or need to be operating a business with that name, before you did/do.
If their website is up, transfer the domain, otherwise get the site up and running.
got to http://www.uspto.gov and do a trademark search, to see if they have one
