InactiveI’ve already replied over on the GPWA. But my advice is there is a legal precedent. The site 32x.com has been promoting a white label casino since 2006. If it were me, I would hand it over.

Here are the section codes: US trade mark no. 78,654,867, European Community trade marks nos. 2814424, 2907426 and 8398695 and UK registered trade mark no. 2509861
To the best my my opinion and knowledge, the US patent is for the “word” only; in the United States, you cannot trade mark a number. My domain is in the US. Also, as I have stated, 32x.com existed BEFORE 32red.com and it’s corporation.. I DO intend to fight!!!
Also, the term “32x” is a registered term. It dates back to the IBM and Bell labs days of the internet’s creation and It was foundationalized by Sega in 1994 for the Sega Mega Drive 32x. I have had a Sub-Domain, sega.32x.com, since 2005.. I can prove I wasn’t trademarking their name. Also in 2005, in my opinion, 32red was a tiny little company. I have never even applied for their affiliate program and I belong to numerous major affiliate programs. If I were trying to steal their patent, I would have been an affiliate of theirs.

InactiveWhen you created 32x in 1997, what was the domain used for? EG when did you start using it in a gambling related nature? As you have already stated numbers are not trademarkeable so its X vs Red … no comparison!
IMO, this is nothing more than more buddy-buddy BS – If I were in your position I would not hand it over.

Inactive32 has been on one hellva witch hunt as of late! I think they are crossing the line here and if it were me I would not hand them squat! I think its a bored intern doing way to much searching..

If you had a domain you bought the other day and they knew about it, they would probably do nothing about it.
I wonder if other companies wait until authority is built up before going in for the steal?

EvidgignivaceMemberI would definitely have to say that I am glad that I have honestly marketed my domain for the term “32x”, and not 32red as they have claimed. I feel that they have no leg with which to stand and so does my representing law firm, in my opinion.. My Google analytics are proof of my searches. 32, red, and 32red have never shown in the history of my searches on Google or Yahoo, to the best of my recollection, in yahoo site search and Google analytics.
This is not just about my domain. This company is, in my opinion, destroying the gaming industry; they are part of the problem. In my opinion, we are trying to survive and they are profiting on our demise…
I am not sure if I will win or lose, but I will not hand my domain to them. I will fight!!

InactiveSounds like they typed in a whole heap of gambling terms into google.. and narrowed down the list to any domains with the word “32” in them.
They’ll try for some “trademark” bs routine – but you should be fine. 3 letter domain.. tell them they can purchase it, and its 15 year history for a nice princely retirement price.
next thing you know.. “big red” chewing gum is being sued for having the word “red” in their business name by 32red. hahah.

Interesting point! I felt that way myself.. I noticed that there are several companies that, are in my opinion and knowledge, in direct violation right here on CAP. They all have the term “red” in their domains and they are gambling sites, not affiliate portals such as we are.. This makes me, and this is just an opinion, feel that they are NOW after our portals. To the best of my recollection, WH was a corporation. So why do they attack our portals right here on CAP where we are supposed to be protected, and then create a thread bragging about it? In my opinion, that’s cowardly!

It’s a clare case of “Reverse domain hijacking” also known as reverse cybersquatting, And you can sue them for that. Thay have no legal rights and they are out fishing. And they know it.
I think the lawyer just want to make money from the client. don’t ever put your defens in a email. If they want your domain let them submit all paperwork first.
Just say you are not turning the domain over and the the domain are not for sale.
You will finde more info on your situation if you serching for “reverse cybersquatting” and Reverse domain hijacking.

Thanks, that is exactly what I intend to do. I had forgotten all about the cybersquatting law…

I am replying to several points that are being made, that will unfortunately seem empty due to the fact that I could not quote the respondent. I am sorry that I could not include the quoted response, but it violates CAP User Permission Guidelines, regarding the user that I would be quoting..Here is the reply:

I notice that you didn’t quote any Trade Marks. EU Trade mark# 8398695 and UK Trade Mark# 2509861 are for the number 32, in which your company professes that I am in violation. I am in the US. You are going to have to prove what you are stating, which means that you are going to have take it to Federal Court. This is not cut-and-dry, like William Hill in my opinion. You need to do your Patent and Trade Mark homework before you make statements in a public forum. My domain is not worth what you will have to pay to get it, not to mention bringing yourself into the US and world media. I will not just hand you my domain. Also, maybe your lawyers should be making statements. I personally feel, in my opinion, that it is unprofessional for a sales rep to be making legal statements for their company..
It is now obvious that by exposing myself like this, that you will no doubt have to make an example of me to make you corporate point. But, that is what you are going to have to do. I will not just hand you my domain.
By the way, I am not an online casino. I am an affiliate portal, from which companies like yours, in my opinion, make their money. If that were not true, you would not be in this forum. Also in 2005 32red, in my opinion, WAS small in comparison to the larger casinos like 888, Party Poker, and Golden Palace who were big at the time.
