Just wondering how many website owners are still waiting to see what happens before selling or taking their sites down.

we have to see the reaction of the players and affiliates, then get sound legal advice on our liability within 270 days.

We also need to see if this is a french tatic to make everyone love regulation.

    End of November is key

I don’t see the merit of waiting for 270 days. When the bill is signed, it becomes illegal for us to promote betting via affiliate links. Are you going to risk the chance of prosecution during the time they implement the banking practices, for “aiding and abetting” ? That is the question that you must ask yourself.

This is completely debatable, this is not fact. We were in a grey area and any of use COULD have been prosecuted for “aiding and abetting” before this, you know that, right? I was told that by a lawyer years ago. The law has not changed substantially in that regard.

I would not want to bet my house on that. The grey are has become black. You will be breaking the law after the bill becomes law.

    SulkyGirl,

Yes, depending on what state you live in, you certainly could have been nailed before. However, the lack of a corroborating Federal law usually (but not always) discouraged prosecution.

When this puppy becomes law, and the government implements its banking stuff in 270 days, I would be willing to bet (no pun intended) that the DOJ will be using this law as the impetus to go after gambling entities, affiliates being one of them.

Of course, all of this remains to be seen. I will be disabling my affiliate links when the bill is signed, and will just be watching carefully. Right now, things look tremendously bleak. Still waking up in the morning in a cold sweat, wishing that this was all just a dream, but it is important to be strong and move on, IMO.

My interpertation of the bill states that is is the transaction part that is going to be enforced and since I don’t accept any type of transaction on my site I only advertise, I would have to wait until further notice to take any drastic measures. I voted wait and see.

I think another Poll answer should exist:

Not living in the USA, will continue business as usual

Since there is also the rest of the world which actually is growing at a faster rate.

Well maybe I should have clarified by saying this poll is for those that are affiliates in the U.S. and are directly affected.

Genuinely curious, and not trying to be a pest, but what part of the law (exactly) are you all interpreting in that fashion? Which part of the law is the part that is new, and different from the Wire Act, that is making you concerned when you weren’t concerned before? Because I have ALWAYS been concerned, but haven’t seen anything in particular that is of MORE concern that it was before.

(by the way, I AM really worried, but I haven’t read anything conclusive, and since other people FEEL conclusively, I want to know why. )

My original intention was to yank all banners, and let the sites grow in the SERPs for awhile, however, since alot of my income came from http://www.spiceyournet.com and I don’t see much coming that way anymore.. I find that I need cash NOW for a b-day, halloween costumes, another B-day, Thanksgiving.. Christmas… lol get the idea..

    So selling is me :P

Peralis do you have room on your couch for a few thousand US affiliates?

I promise to tidy up after myself and will chip in on beer and other essentials….
