Because they are marketing your programs they are ok.

If they were marketing a competitor but trading on your name then they would be evil hooligans worthy of stoning.

OK, but what if the guy who has sharetherake.net is trying to sell it on ebay for $9,999. Seriously, he is.

Just hope Golden Palace doesnt buy it!

Actually its his domain if he can find anyone goofy enough to pay that much more power to him.

That being said, if the nut who buys the domain throws up a site that would adversely effect your client you have every right to beat them with the legal stick until they either surrender the name or remove any offensive materials.

He’s listing it as a fully developed, money-earning affiliate program.

Looks like the guy is trying to sell something on Ebay under false pretenses. In other words he thinks someone may not realize that the content they see when they click on “his” link is actually your program. IMHO, it does not look like he’s trying to steal from you, rather, he is trying to steal from any Ebay member that falls for it. But to answer your ethics question- looks like a real no no to me.

Ahhh…. I didnt realize thats what he was doing…. Break out the stones.

I would contact eBay and let them know this moron is trying to rip off their bidders.

    Hi

I bought wagerprofit and redirected to wagerprofits sign up page with my affiliate ID about a year ago.

I didnt have an ethical problem with this since it was just a way of getting people to wagerprofits and it is a common type in traffic mistake. This boosts wagerprofits.com business.

Jeff you could have contacted me directly since you have my contacts and I would have sorted this out with you. I genuinely didnt think it would cause anyone any concern! Please just get in touch if this remains a problem!

    Hey Devendra,

Maybe Jeff wanted the opinions of those here on the board before doing anything – after all, if Jenny hadn’t mentioned the above fact, Jeff might have let you sell the sites that way.

No harm in asking for advice from colleagues before tackling a situation.

    Jeff was just getting informed.

FYI: I had a design client once, who had no clue. He bought Starluck-Casino.com or starluck(s)casino.com for three thousand dollars on ebay.

I told him not to pay the guy (he’d had arranged 1000 monthly payments and had already sent one) and to ask for your money back.

At first the ebay auctioner was not very nice, until I pointed out that he had resold Starluck’s COPYRIGHTED materials. You CAN’T resell someone elses product. It’s like burning copies of Windows XP and selling the pirated CDs on ebay…

    It’s an obvious bad move.

Long story short, my client got all of his money back.

    Cheers,
    B

Is wagerprofit for sale at eBay or just sharetherake?

I viewed the auction and its not explicit as to what you receive other then the domain sharetherake and the ability to participate in the sharetherake affiliate program.

I think the price is patently silly, but if you had a buyer dopey enough to shell out close to $10K for a domain the most you would be guilty of is taking advantage of a fool. Its certainly not a nice way to earn a profit and not something I would do, but its not illegal.

Gee… this is a stumper… what do you guys think about this?

The starluck site I mentioned above was a complete copy of the Starluck site. When a visitor clicked download it downloaded to his affiliate code. (in other words was NOT a redirect) – this poor sap thought that he OWNED Starluck casino.

Starluck probably wouldn’t have any problem with this type of marketing, however when you falsely imply to someone that they are “owning” the casino after purchase, its slimey and I think a lot of people would consider it illegal.

So – use those techniques to market the program in question, but not to shove off on someone for 10,000.

I didn’t visit the ebay auction, was basing my postings on this:

He’s listing it as a fully developed, money-earning affiliate program.

Which it is NOT, it is a RE-direct or a COPY of a fully developed, money-earning affiliate program.

This happened to Slotland some time ago also. Someone sold Slotland on ebay – but all it was is a mirror front and it had an affcode imbedded.

    That is criminal.

It is up to Jeff if he wants to go after it now or later – but now seems more fair since the real criminal is still holding the domain. Later it will just be the sucker.

As for just mirroring the wagerprofit site to bring in new affs – this is done widely. One should always get the permission of the aff program before mirroring a site. Many programs approve, some will not let you use their copywritten site for your purposes.

Personally I see no harm in this and I have done it too. It is just good business to make sure it’s ok and ask first.

For clarification: wagerprofit.com was just an affiliate redirect and was never on ebay and had nothing to do with the ebay auction that is I think the real focus of Jeff’s ethical concern

I didn’t even know what shaketherake is, if you had asked me 5 minutes ago I would have my first reaction would be that it was a gardening tips site rather than an affiliate program :)

Well, if you look at his feedback he seems to have done decent business for some time. Odd, to be switching to something criminal.

The only thing is they are saying they can promote the sharetherake program.. However isnt this up to jeff to approve people. So how can they place value on that on ebay?
