I agree that this is not the best use of both of our times, but you have to understand I am loyal to merchants and if I feel that they have done nothing wrong I will stand up and fight for them.
I am aware of the case with the WPT, we are not stopping any player from being picked up by any brand/poker site all we would like is the option to use them for any future marketing that we might do.
I think it is great that that you have added PNR to your site/s and I do reallyhope that you keep it on them, but can tell me what other issues you have with PNR?

for starters I really suggest you go read up about WPT getting sued by a bunch of their players because of a damn similar hijinx they tried to pull…. Then maybe consider peoples’ right to privacy and not getting exploited. they are paying to play on your site, you’re not paying them anything or doing them any favors. remember that.
what do u need their “likeness” for? You have no right to use their names/likenesses. no other site does this why the hell should they let your site do it. You Might get away with it if you were some megasite like stars or fulltilt (but no, they actually pay players or ask their consent before using them in marketing campaigns.. obviously they can mention usernames, but they can’t use a persons likeness or real name without consent) , but with less than 200 tables and bugger-all tournaments running you are taking the p**s here by adding this clause.
If the next ept winner plays a sat on ur site and doesn’t win a seat, u can still use their name and likeness in your promotional blurbs etc. this is a ridiculous clause, and it was obviously left open-ended like this on purpose, or whoever thought it up is pretty brainless imo. you don’t even mention a timeperiod, or the type of promotional material you can use. it’s so wide open you can do whatever u want.. you didnt mention newsletters in your clause, obviously you leave it as open-ended as possible so you can use their image/photo or whatever on ur site/promotions or even on TV and say they play on ur network. very nebulous wording imo. If you said “we have the right to mention you in our promotional newsletters” that might be ok.
Why can’t they get sponsorship? Well if someone else has the legal right to use you in their promotions, I am not going to sponsor you so I can use you in mine am I? srlsy…
bottom line: pay for the right to use players’ names/likenesses like everyone else does or all the decent/big players wont touch your site. Poker players like their privacy and letting people know that player X = username X on your site is a breach of privacy imo. I’m just glad I spotted the smallprint or I might have been foolish enough to participate.
I added paynorake to my rakeback site yesterday and I am seriously thinking of taking it down due to this and other issues tbh. The fact that you don’t see a problem with the clause is quite worrying tbh.
