KWBlue here was Natalie’s earlier response. I know you feel passionately about this issue but it’s obvious the affiliate is NOT active and wasnt active for quite some time. Maxus even admitted this. And yes their terms DO state if you arent active then your account status can be change to inactive and you wont recieve commissions. I am NOT saying these are optimal terms, but they are what’s posted:

5.5. In any case where the Referral Company chooses a compensation program where GW agrees to reward the Referral Company for the lifetime activity of the referred player, the Referral Company must maintain the status of “Active Affiliate” to be eligible to receive compensation for old Referred Players. “Active Affiliate” status being defined as a Referral Company that refers at least one new depositor per calendar month. In the case where a Referral Company fails to maintain “Active Affiliate” status for a period of six months or more, GW reserves the right, at their sole discretion, to completely discontinue any type of service. When you received that payment for $3868,29 in January, you were already inactive for 6 months, and I wrote to you an email, letting you know that you need to start sending at least one player per month to us. Actually, let me remind you that you did not even know you had that commission accumulated, because it took me a while to get a hold of you. At this moment your CoolCat account is inactive for 9 months, while Palace of Chance is inactive for 14 months. You do not even have a link of our casinos on your site, as we are not getting any clicks from you at all. I do not see an attempt of you promoting us, or having any kind of interest for our brands.
We believe that a partnership is built on a principle of mutual cooperation: where you give us constant exposure and we make sure to convert your traffic and retain the customers. While you were not promoting us, and even stopped from checking your account, we were trying to reactivate the customers you brought to us a year ago, and make them deposit again. That’s how you’ve accumulated a commission of $3868,29, which I made sure you got. However, after this effort we expected you to give us at least some exposure on your site, which did not happen.
So, after all your account is inactive, and if you need to talk to me, please reply to the email I sent you last week.
If you dont agree with these terms and conditions the option to leave the program is always on the table. Just be aware if you do so you wont be paid commissions any longer.
Like I stated earlier let me talk with Natalie and see what can be done. I think what we probably need to focus on is whether or not those terms were in place when Maxus joined and sent the players in question. If they werent they we have a case to be made that the NEW terms ARE predatory as they are RETROACTIVE. If those terms have been in place since the beginning then the affiliate has a responsibility to remain active if they want to continue to be paid commissions.
