For what it’s worth, here are some defense items that you can use, should you have the need to use them (some are better than others, granted):
– In the event of an audit of your books, only show bank direct deposits
from NETeller (or whoever you use); no need to divulge the sources.
– Claim all income, and pay all taxes
– Online Poker Sites advertise on American TV
– Google, Yahoo, etc., accept my Poker/Casino Site URLS’s
– I have a legal disclaimer on my site (make sure you have one)
– My site doesn’t involve gambling, only information
– My sites do not involve Sports Betting (make sure this is the case)
– I “advertise” sites that aren’t hosted in the U.S.
– My sites are information-based sites. Freedom of speech grants me
that privilege. Alcohol, tobacco, pornography, etc., are permitted.
– No one from U.S. pays me directly; only non-U.S. entities
– All my customers are from outside the U.S. (let them prove otherwise)
– 1961 Wire Act is very ambiguous on how it applies to Internet. Use
this as a basis to challenge the Washington State law.
– Horse-racing betting online in U.S. is allowed.
– American Indians have exclusive gaming rights.
– How can anyone determine if my customers are from U.S. or another
country ? Why can’t I advertise for players outside the U.S., as long as I
pay taxes on earnings ?
– Fidelity and Merryl Lynch are invested in SportingBet company. Why is
this any different from what I do ? Fidelity and Merryl have offices in
Washington State.
