I know that sometimes they will show a domain as available when it’s really just in a grace period. This has happened to me before when I tried to register a domain.
Perhaps it was ready to permanantly expire and he was notified somehow that someone else was trying to register and he woke up?
Seems strange though that this would happen twice to you with the same person.
