Duplicate content has to be done in a malicious way for Google to take action IMO. There are hundreds of news sites out there that all use the same AP Newswire reports on their sites, but they don’t get penalized. It’s more than just having groupings of words that match another site, it’s more about the intentions. And how exactly Google figures that out is anyone’s guess.
