I agree with croupier on all counts, including speaking about this situation in general, and not specifically.

That’s good.
Others have recently said that they put things in contracts that they would never enforce. In that case, the regular business world just saves a little breath and leaves those things out of contracts. Imagine the funny look I’d get if I produced a contract and said the same in front of a business partner’s lawyer.
