Looks like the guy is trying to sell something on Ebay under false pretenses. In other words he thinks someone may not realize that the content they see when they click on “his” link is actually your program. IMHO, it does not look like he’s trying to steal from you, rather, he is trying to steal from any Ebay member that falls for it. But to answer your ethics question- looks like a real no no to me.
