I still think you should just have google ban the domain and start fresh .There are few affiliate programs that will probably not pay you or the guy who has your domain.You will get your serps back on a new domain with this old content if you ask google to remove the stolen domains from index.Just my two cents ,pay a lawyer to write the letters and usually the registrars will reply to a lawyer.
