As I recall it, the case was dismissed not because the plaintiff wasnt doing anything wrong, but because they had not been charged with anything and thus had no reason to be in court. The case was dismissed with prejudice meaning that it couldnt not be brought back to the court in the future.
Also agree with professors comments, these guys arent on the offensive they are fighting for their freedom. The government/state das etc have been spying on these guys very closely, I am sure they have the entire scenario played out.
