Poker was declared as a game of skill by the government here in Austria. We have two licensed online casinos and several sportsbooks.
So Poker is a safe bet. The DAs have not gone after any (in Austria) illegal gaming enterprises so far. It seems they have more important things to do than to enter an “Internet war” they cannot win.
Our German friends (in other words their lawyers) like to send us “cease and desist” orders, worth $300-$400, if they spot any links to foreign gaming sites on our websites. :hehe:
My favourite answer, per email: “Do you know about that mythical border ?” 
In Germany they have a few sportsbooks, no licensed online casinos or poker rooms. Foreign gambling operations are illegal of course. Same goes for Switzerland, if I remember correctly.
