Not to be too Cynical but if you choose to host offshore from the US due to legal concerns wouldnt it be advisable to choose a country that is not part of the US/UK/CA triangle?
I have to believe that all three (throw in Australia too) are very cooperative when it comes to any law enforcement issues and would be more then happy to surrender data that would aid one of the others in an active investigation.
I think if I went offshore it would be to a country that doesnt fall right in line with US policy on every issue.
