    As far as the domain name…

    This is dictated by ICANN policy.

    The Registrant info must be accurate.

    The Admin and Technical contact info must be accurate and contain a valid email address.

    Never ignore email to either the admin or tech email accounts because if the Registrar or Icann contacts you and you fail to respond, policy states your domain may be disabled for failure to respond within 14 days.

    Brian at present the subject of US based hosting is a very popular topic of coversation with arguments for and against. I can tell you that the majority of Casino Portals ARE hosted within the US and Canada.

    If proposed anti gambling legislation is enacted in the future I suspect that will change quickly.

    Not to be too Cynical but if you choose to host offshore from the US due to legal concerns wouldnt it be advisable to choose a country that is not part of the US/UK/CA triangle?

    I have to believe that all three (throw in Australia too) are very cooperative when it comes to any law enforcement issues and would be more then happy to surrender data that would aid one of the others in an active investigation.

    I think if I went offshore it would be to a country that doesnt fall right in line with US policy on every issue.

    Anywhere the FBI has close cooperation (UK, Canada, Aus., etc.) they can walk in without much fuss and take the harddrive off the server. Especially in these authoritarian times we live in. The US would be even easier.

    I understand that but when they do investigation, what are they look into first?

    For example, when they found a gambling portal, they may first look at Whois database to see if the owner is from US according to the owner address. Or maybe they will trace if the portal is hosted on US. Without these information how can they so sure they are targetted the right person? You can edit your domain registration details (set to non-US address) easily these day and if you hosted your site in UK (which is very lenient to online gambling especially to sportsbooks), I think you are not likely to be targetted.

    There are thousands of gambling portals out there and many owners are non-US residents, do you think the FBI willing to spend they time on investigeting all these portals. Of course they can do that but it is a very time consuming process. They are most likely to target those give them direct information (Whois, Server hosted etc) first.

    The reason why I said no to Australia or Canada server is because Australia also ban online gambling (although Casino Rewards is based in Australia) and Canada may follow US footstep. UK is not likely to follow US at this moment I believe because of their UK based Sportsbooks.

    Just my opinion. What do you said?

    Hi Brian,
    You’re right. It would take them forever to weed through everyone in the gambling industry. Even so, I think there is a huge difference between an affiliate who is advertising by placing banners on their websites and a casino operation. From what you’re saying, it sounds like you are a front for an operation, meaning when someone hits your site, it opens a casino website. That could cause some problems, especially if the domain is hosted in the US.
    From an outside observer, you look like the operator and operating a casino in the US is illegal.
    I may be wrong about the circumstances, and I’m no lawyer, so take this at face value.
    I, for one, don’t think anything will happen to affiliates. There are too many of them and hopefully Jihad Johnnie Ashcroft will be out of a job after next year.

    Jeff, my site would operate as a casino sublicensee. To my knowledge, there has not been any cases against casino affiliates, sublicensees, or promoters, yet. I’m looking for a relatively safe, temporary solution which probably includes offshore hosting and address for now. The safest way is to get an offshore entity but that will cost a few grands. And Jay Cohen of WSEX is the only one to get convicted and jailed by the U.S. as a casino owner ( 5K fine and 21 months). There’s not that many links on this subject, here’s one.
