As we announced recently, our clients have now moved to be hosted in Malta under a European license (LGA).

Due to the changes in the market and current industry standards, we revisited the financial and business terms of the current Affiliate program.

The terms were updated on the BrightShare site, and will be taking effect as of May 1st 2013.

For your convenience, the main changes to the terms and conditions are listed below:

Rev share will be calculated on a sliding scale according to the number of new players the affiliate brings in each month.
We will continue with NO negative carry-over, with the addition of a high-roller policy.
Payment will be made for new unique players that were not already active with any of our clients.
Rev share affiliates will receive a single aggregated rev share payment each month for all products, markets and brands.
Revenue share for markets that are closed (i.e. France, Italy, etc.) will be paid based on a reduced rev share percentage.

NOW YOU GOTTA LIKE THIS AT THE END OF THE EMAIL
We are, as always, 100% committed to our tag line: Playing Fair, Sharing Success. You will continue to enjoy all the benefits of affiliating with BrightShare, with top revenues, payments like clockwork and the dedicated support of our professional affiliate managers and support team.

I have also been cut on the agreed rev share % from other microgaming casino aff programs –

I also have a bespoke agreement. While I’ve been informed this will stay as is, my concern now lays with the player quota clause (inactive account ruling), which was omitted (left-out) of the email received as per the OP posted:

    xxxhttp://www.brightshare.com/terms-conditions.html
5.5. For the purposes of this Revenue share Plan, an Affiliate shall be deemed by BrightShare as an Inactive Affiliate in a Plan, if the Affiliate does not deliver any new depositing Players for a period of three (3) consecutive months in an individual Plan.
The monthly Revenue share percentage payable for an Inactive Affiliate will be adjusted to 15% for all Players’ net Revenue linked to this Plan. Should the Inactive Affiliate deliver new depositing Players, at any time thereafter, the Affiliate shall become active in this Plan and be entitled to the revenue share percentage as per the table above.

This question needs answering by Brightshare

    • Are these new T&C’s being retroactively applied?

No one from Brightshare seems to want to comment on this question or others; the silence is deafening. I’m going to assume then these T&C’s are to be applied retroactively because if they are not then why not just answer the damn question!

More importantly why leave out the most important clause 5.5 from the mailer sent? No need to answer that I think we all know why.

Its been asked at numerous affiliate forums and people are still no wiser. Today is the 30’th April and May 1’st (tomorrow) marks the day these new T&C’s come into force but Brightshare seem happy keeping all of us in the dark.

While I make ok money with Brightshare, I wont hesitate kicking them to the curb should they make these T&C’s retroactively applied.

This is getting beyond a joke now.

I think it’s time affiliates banded together and take a class action law suit out against these companies who think it’s ok to break agreements and in doing so lie, cheat and steal rightful commissions. Lets get them in court and see how they fair breaking contractual agreements.

NB – Given Brightshare are also eCOGRA Affiliate Sealed maybe it’s time to take a class action against eCOGRA too. These SEALS certainly are not protecting our livelihoods!

I think we are just seeing the future of affiliate marketing , if/when these markets regulate I am sure the affiliate share will be used to pay most of these expenses.I sent them about 30 players this month so no danger of the quota but we can all have good and bad times through no fault of our own and I really don’t like the quotas. If they want to bring quotas in they should look at our total relationship and maybe they need to start buying back the affiliate accounts for those affiliates who may not have an active website .

    And that’s the BIG issue!
We don’t have a gatekeeper who mystically vetoes traffic we send. This makes Quotas and High Roller quarantines bad news. We get hammered on bundling already. Now affiliates will be chastised if they don’t meet quotas and also if they happen to have a player(s) who win $8,000 or more.

Are these new T&C’s being retroactively applied
    ?

Larger affiliates; those who can drive 25+ new depositing players to these casinos month in month out, are the winners here.

If Brightshare are truly sincere about “Playing Fair, Sharing Success”, then I agree they need to offer a buy-back initiative, otherwise, these new T&C’s are nothing more than a means to steal rightful income from small affiliates, which is anything but “Playing Fair”!

PS Small affiliates make up a larger percentage of all affiliate programs.

What a poor step by Brightshare. They have been around for long enough to understand how important reputation is, especially for MG casinos.

I think the fact no one from Brightshare have answered the question, “are these new T&C’s being retroactively applied?”, is pretty low too. Just saying :wow:

Fair crack of the whip CAP, Brightshare are one your sponsors.
How about showing some interest in affiliates welfare!

I highly appreciate AGD’s efforts. It’s out of my understanding why Brightshare throws away their reputation after all these years. There is just no excuse in this behavior.

    It’s called greed!

Brightshare have made literally 100’s of millions of dollars from their affiliate partners. Instead of acknowledging this and being honourable in maintaining our “lifetime” agrements, Spiral Solutions instead devise ways to rob their affiliates of their rightful income.

Ladbrokes (kicked USA affiliates to the curb), Wagershare, Roxy Affiliates, Brightshare and now InterPartners. The sharks are starting to show their teeth and true dodgy colours!

Apart from AGD, no other affiliate associations are standing up against this tyranny. Yet are more than happy to keep using affiliates as pawns to fill the membership numbers and use these to turn a buck. And selling their members out for money, is about all these places do.

While I personally don’t always agree with AGD, I’m happy to stand back to back with him and other affiliates to fight for our rights on our standing contractual agreements. We need to send a clear message to these affiliate programs, that enough is enough!

I spotted this on the GPWA home page just now:

    Brightshare-GPWA-Dec2012-125x125.gif

It’s not like the GPWA are not aware of these retroactively changed T&C’s But hey, it’s business as usual for them. As long as they’re (Corfman) is not getting his cash stolen, he doesn’t give a rats about GPWA association members!
