    Default Bwin won the EGR award being Europe's best Sportsbook Operator of the year

    bwin garners the “European Sports Betting Operator” award at the sixth EGR Awards ceremony on November 25th. This award is given to the European operator who wins the battle for customers in the highly competitive European sports betting market.

    Moreover Manfred Bodner, our Co-CEO, was honoured with the Contribution Award, the most prestigious award for top managers in the eGaming industry. Particular mention was made of his contribution to building the brand, his innovative decisions in bwin's initial years and the service he rendered to the entire industry.

    Nice!! While 100s if not 1000s of affiliates are suffering we have to sit here and listen to this classless selfplug. I really find this in bad taste to be honest. While the affiliate head is on 3 weeks vacation the affiliate community must wait and suffer PREDATORY antics from BWIN.

    It is not professional to attack employees on a personal level...specially when you spread rumors and information you got from just somewhere.

    NO personal attacks were shared here. My opinion was your posting on various forums in an unprofessional way. Because I call you unprofessional - your saying I am unprofessional. We can turn this into a circle mate - I can say you just attacked me as well calling me unprofessional.

    What i was simply saying is handle affiliate issues first before sharing information on how good bewinners is and winning awards while countless affiliates are suffering.

    RUMORS? How so? You referring to Gehard being on vacation for 3 weeks? He is the director of affiliates correct? Was he not on vacation for 3 weeks while we all wait for the old terms and conditions? Or while we wait for the predatory terms to be revised?

    I am calling you out now - what is the RUMOR? Is not what i state factual?

    By you calling them rumors (untrue) you are supplying false information along with not being transparent from the beginning!

    I suggest you check your own moral code before questioning mine.

    Note: I formally request you to supply me with an explanation on what these rumors are" I suspect like previous requests you will ignore my requests again. History seems to repeat itself with you mate. No offense. I expect you to be more professional mate since you represent Bwin. Its your job - please do it.

    The thing is that bwin breached contract with it's affiliates. If this had happened in the US, there would have been a lawsuit in a nano second.

    Bwin and anyone can create any terms they like and that is fine, if the terms are disadvantageous to affiliates, affs just won't sign up.

    But once affs are signed up under a set of terms, they cannot be changed without the consensus of both parties in the contract. Especially where there is reinbursement for services rendered involved.

    Affiliates kept their side of the contract, and bwin is legally obliged to pay as was agreed. What bwin does with future affiliates is entirely up to them.

    The "escape clause" stating that "bwin reserves the right to change the terms of the contract anytime" is not legally acceptable in a context where it involves reimbursement for services rendered.

    It is widely used in online contracts, but it has no legs except in the situations it was designed for - when a company allows free use of it's product (usualy a program, software) and reserves the right to start charging for it at a later date.

    In a situation where such a clause affects monies owed for services performed, these clauses are deemed "unreasonable" by the court and thrown out. There is precedent.

    Hence Bwin is in violation of the law by refusing to pay what was contractually agreed upon.

    Should Bwin ever want to enter the US market, they can be sure this criminal behavior will be presented to the licencing comittee.

    Bwin is a large, thriving company in Europe, but they are a nobody in the US. I think bwin needs to think very hard about how it conducts itself in the US, in case they ever want to try to be licenced here in the future.

    Bwin can keep the new terms but not apply them to affiliates that signed a different contract previously, or bwin can contact affiliates on the old system individually and get them to agree to the switch. Anything else is breach of contract and can be legally pursued.

    Rewards Casinos, a few years back, changed the way they computed rev share, they did talk to individual affiliates and gave them a choice. Today most affiliates are on the new platform.

    So it's not like bwin would have to reinvent the wheel here...

    I guess I need to mention here that I am not a lawyer and that this is not to be considered legal advice.

    Bwin sent out a letter to many affiliates, quite wide spread:

    Dear XXX,

    bewinners wants to work with the best!

    As you have not achieved at least one NPA within the last 60 days, we would like to inform you that we will close your account in 30 days.

    Kind regards,
    Your bewinners team

    Talk about personal insults. Couldn't this have at least been worded a bit friendlier, or included some marketing materials to encourage productivity during the remaining 30 days?

    Yep allot of affiliates got this. I find it hard since the Stats do not seem to work. Are behind.
    I am not sure what is going on anymore. The head of affiliates is still on vacation so maybe well here some news when he is back.

    Also Mallai still has not given the old terms. When will this happen.

    It does appear some affiliates now want to take this to court.
